1. Who this agreement is between
1.1. These terms are an agreement between Sitemapper (ABN 76 924 062 941), called "we" or "us", and the person or business that owns a Sitemapper account for one or more parks, called "you".
1.2. If you accept these terms for a business, such as a company, partnership or trust, you confirm that you are allowed to agree to them on its behalf, and the business is bound by them.
1.3. Your account (we call it a tenancy) can hold more than one park. These terms cover every park in it. If your account has more than one owner, each owner accepts these terms.
1.4. You can invite staff to help run your parks. Staff who are not owners are not asked to accept these terms, but you are responsible for how they use Sitemapper and for the information they put on your map.
1.5. Guests who use your park's map are not part of this agreement. How we handle their personal information is set out in our privacy policy.
2. What Sitemapper does
2.1. Sitemapper lets you build a map of your park in our admin portal and publish it to your guests through our app. The map shows your sites, amenities, trails, exits and the other places you add. Your staff use Sitemapper to receive guests' help requests and to manage the map.
2.2. Guests' phones keep a copy of your published map so that it works without a signal. A copy on a phone is only as current as the last time that phone had a connection.
3. Free drafts and paid parks
3.1. Building a map is free. A park in draft can hold up to 25 places (exits and entries do not count towards the 25) and one staff login. A draft is never shown to guests. There is no free trial of a published park: the free draft is how you try Sitemapper.
3.2. You pay when you publish. An owner or manager publishes a park from the admin portal. To publish, the park needs a boundary and at least one exit, and every place must be inside the boundary. The portal shows you the price before you pay, and the park goes live once the payment is confirmed.
3.3. A park that has never been paid for stays a draft.
4. What a published park costs
4.1. The price. A published park costs A$16 a year for each site, or A$3 a year for each hectare of land, whichever is more. It is never less than A$1,188 a year and never more than A$7,200 a year for one park.
4.2. What a site is. A site is a place where one party stays: a numbered pitch, a cabin or a glamping tent. These are not counted, and you can add as many as you like:
- amenities, such as toilets, showers, water, reception, fire pits and trailheads;
- camping zones, trails, exits and areas of mobile coverage;
- bush campsites, meaning a camping area with no numbered sites.
4.3. What the land is. The land is the area inside the park boundary you draw, measured on the ground and charged in whole hectares.
4.4. Trail parks. If your park's property type is trail park, the land part of the price is capped at A$3,600 a year. Sites are still charged at A$16 each, up to the A$7,200 maximum.
4.5. Groups. If your account has three or more published parks, each published park is 15% cheaper. The park that makes three gets the discount straight away, and the parks already published get it from their next renewal.
4.6. Staff logins. Each published park includes five staff logins, shared across your account. An account with no published park has one. Each login above that costs A$12 a month, charged monthly on the highest number of extra logins active at any time that month. We never refuse a staff login and never switch one off because you have gone over your included number.
4.7. Setup service. If you would like us to trace your existing park map and place your sites for you, we offer an optional setup service for A$590, charged once. You arrange it through the contact page on our website, and we send you an invoice for it.
4.8. Unlimited guests. Guests, map views and map downloads are never limited, measured for charging or charged for.
4.9. Money and tax. Prices are in Australian dollars, rounded to whole dollars, and are the full amount you pay. Sitemapper is not registered for GST, so no GST is charged and our receipts are not tax invoices. If we register for GST, your price will not rise because of it, and our receipts will become tax invoices from then on.
5. The price follows the property as it really is
5.1. The price depends on what you put on your map, so you agree to map your property as it really is:
- one map for each property. Do not put more than one property on a single map, and do not split one property across several maps;
- every site mapped as a site. Every numbered pitch, cabin and glamping tent goes on the map as a site, in the category for it, and not as an amenity, a zone or some other kind of place;
- the boundary around the land the map covers. Draw the boundary around all the land your map shows to guests;
- the right property type. Choose the property type that truly describes your property. Once a park has been charged, only we can change its property type, and a change takes effect from the next renewal.
5.2. We may check. We may compare your map with the property itself, for example using satellite imagery, title or council records, your website and your booking listings. If your map does not match the property, we will tell you what we found, and you have 30 days to correct the map or explain why it is right.
5.3. We may correct the price from your next renewal. If the map is not corrected within those 30 days and we are satisfied it does not match the property, we may charge from your next renewal on the number of sites, the land or the property type that matches the property. We do not change your price part way through a year you have paid for.
6. Measuring, renewal and the first year
6.1. The year runs from 1 September. Every published park renews on 1 September.
6.2. Your first year. A park published part way through the year pays from the day it is published to the next 1 September, at its yearly price, in whole dollars. After that it pays a full year each September.
6.3. How renewal is measured. We record each paid park's sites and land every night. At renewal we charge on the highest number of sites, and the largest area of land, that your park held on at least 14 nights between 2 August of the previous year and 1 August. A park first paid for after 2 August is measured on the nights it has before its first renewal. A figure held for a weekend does not raise your price, and removing sites for a day does not lower it.
6.4. No charges part way through a year. Sites or land you add during a paid year are not charged until the next renewal.
6.5. Reminder. About 30 days before each renewal we email you the price your park has been measured at for the coming year.
7. Paying, cancelling and missed payments
7.1. Payment. You pay by card through our payment provider, Stripe. By publishing a park you authorise us to charge your card for its yearly renewal and for any extra staff logins each month, until you cancel.
7.2. Cancelling. You can cancel a park's renewal at any time from the billing page in the admin portal. Cancelling does not refund anything. The park stays published to the end of the year you have paid for, and is then taken down as described in 7.4.
7.3. Deleting a park. If you delete a park, you have 30 days to restore it, and its charge keeps running during those 30 days. We email you before it is deleted for good. When it is deleted for good, its charge ends, with no refund.
7.4. A missed payment. If a payment for a park fails, we tell you, and you have 14 days to pay. After that the park's map is withdrawn from guests, except the help request, the exits and the emergency contacts, which guests can always reach, and your staff can still answer help requests. The full map returns once the park is paid for. The same applies at the end of a cancelled park's paid year. A failed charge for extra staff logins never withdraws your map.
7.5. Disputed charges. If you reverse a charge through your bank and the dispute is decided against us, the park is treated as a missed payment, as in 7.4, until it is paid for.
8. The map helps guests. It does not keep them safe
8.1. Sitemapper is not an emergency service. It does not replace calling Triple Zero (000), a personal locator beacon, or your park's own emergency procedures.
8.2. Help requests go to your staff, not to us or to emergency services. We do not watch help requests or respond to them. Where a phone has no signal, a help request waits on the phone and is sent when it next has one, so it can arrive late or not at all.
8.3. You are responsible for safety at your park. That includes your emergency procedures, having staff who can respond to help requests, and making sure the exits, emergency contacts, hazards and other safety information on your map are correct and up to date. A map can be wrong, and conditions on the ground change.
8.4. The map is a guide, not a survey. Boundaries, trails and positions on the map are approximate. They are not a legal or surveyed boundary.
9. Accounts and staff
9.1. Keep your password safe and sign in only with your own account. You can turn on two-factor sign-in in your account settings.
9.2. Only invite people who work for your park, and remove staff who leave.
10. Your content and your data
10.1. You own your content. Your map, its places, descriptions, photos and logos stay yours. You give us permission to store them, copy them to guests' and staff phones, and show them to your guests and staff, as far as we need to in order to run Sitemapper for you.
10.2. We own Sitemapper. The software, the app, the portal, our icons and our brand are ours. If you send us suggestions, we may use them without owing you anything.
10.3. Other providers' maps. The background map comes from other providers, such as Mapbox, and is shown with their credit.
10.4. Privacy. How we collect, use and keep personal information, including how long we keep it, is set out in our privacy policy.
10.5. Deleting your account. You can delete your account from your account settings. If you are the only owner of an account with a park in it, you need to add another owner, or delete the park, first. When your account is deleted we keep only what our privacy policy says we keep, such as billing records and the record that you accepted these terms.
11. Changes to these terms and to our prices
11.1. Changes to these terms. If we change these terms, we will email every owner at least 30 days before the change takes effect, and ask you to accept the new version the next time you sign in. If you do not accept, you can cancel your parks' renewal, and they stay published to the end of the year you have paid for.
11.2. Changes to our prices. We may change our prices from a renewal, never during a year you have paid for. We will tell you the new price in the renewal reminder at least 30 days before, so you can cancel before you are charged.
12. Ending this agreement
12.1. You can end this agreement by cancelling your parks and deleting your account.
12.2. We can end this agreement, or stop a park's renewal, if you seriously break these terms and do not put it right within 30 days of us telling you.
12.3. Suspending access. We may suspend your access to the admin portal straight away if we reasonably believe your account has been taken over or is being used to break the law. Even then, the help request, the exits and the emergency contacts stay available to your guests.
12.4. If we stop offering Sitemapper. If we stop offering Sitemapper, we will give you at least 90 days' notice, a copy of your map data, and a refund of the part of your paid year that we will not provide.
13. Your rights under the Australian Consumer Law
13.1. Nothing in these terms excludes, restricts or changes a right or remedy you have under the Australian Consumer Law, or any other law, that cannot be excluded, restricted or changed by agreement.
13.2. Where the law allows it, because Sitemapper is not a service of a kind usually bought for personal, domestic or household use, our liability for failing to meet a consumer guarantee is limited to supplying the service again or paying the cost of having it supplied again.
14. Limits on liability
14.1. As far as the law allows, neither of us is liable to the other for indirect loss, such as lost profits, lost bookings or lost business.
14.2. As far as the law allows, our total liability to you under these terms is limited to what you paid us in the 12 months before the event that caused the loss.
14.3. Neither limit applies to loss caused by fraud or wilful misconduct, or to liability the law does not allow to be limited.
14.4. You are responsible for claims made against us by other people because of incorrect information you or your staff put on your map, or because you broke section 5, except to the extent that we caused or contributed to the loss.
15. General
15.1. Which law applies. These terms are governed by the laws of Queensland, and the courts of Queensland can hear any dispute about them.
15.2. Talk to us first. If you have a dispute with us, email us first. We will both try to resolve it for at least 20 business days before either of us goes to court, unless one of us needs urgent help from a court.
15.3. Notices. We send notices to the email address of each owner on your account. You can send notices to us at support@sitemapper.com.au.
15.4. Transfer. We may transfer this agreement to a business that takes over Sitemapper. We will email you if we do, and your rights under these terms do not change because of it.
15.5. The whole agreement. These terms, our privacy policy and the prices shown on our website and in the admin portal make up the whole agreement between us about Sitemapper.
15.6. If part of these terms does not work. If a court decides part of these terms cannot be enforced, the rest still applies.
